These Terms of Use ("Terms") govern your access to and use of the Radiant Botanics website, including any content, features, forms, waitlists, reservations, and links to third-party services made available through the website (collectively, the "Website"). Radiant Botanics is a pre-launch company developing biotechnology-based ornamental houseplants, and the Website is used to share information about products in development, collect email signups and waitlist registrations, gauge product interest, and direct visitors to future crowdfunding or e-commerce platforms. In these Terms, "Radiant Botanics," "we," "us," and "our" refer to Radiant Botanics; "you" and "your" refer to the individual using the Website.

Radiant Botanics is a pre-launch company. Products described, depicted, or referenced on the Website are in research and development and are not currently offered for commercial sale through the Website. Product concepts, prototypes, renders, photographs, specifications, features, colors, sizes, performance characteristics, pricing, availability, launch timelines, and other details are illustrative only and may change at any time, in our sole discretion, before any commercial release. Radiant Botanics makes no representations, warranties, or commitments regarding regulatory approvals, intellectual property protections, patents, safety determinations, product performance, or future commercial availability.
You may join a waitlist, subscribe to email updates, or express interest in products under development. Joining a waitlist or submitting an interest form does not create a contract for sale, a reservation, a purchase, or any guarantee that a product will be offered, that you will be offered the opportunity to purchase a product, or that a product will be delivered. We may communicate with you about Radiant Botanics, products, and our crowdfunding campaign in accordance with our Privacy Policy. You can unsubscribe from marketing emails at any time using the unsubscribe link in those emails.
From time to time, Radiant Botanics may offer the opportunity to place a reservation or deposit for a product in development. Any such reservation is subject to the specific terms, refund policy, and conditions presented at the time of the reservation, which are incorporated into these Terms by reference. Reservations may be limited in quantity, subject to eligibility requirements, and may be modified or cancelled by Radiant Botanics if a product changes materially, is delayed significantly, or is not brought to market. A reservation is not a confirmed order and does not guarantee delivery.
Radiant Botanics may run or link to crowdfunding campaigns hosted on third-party platforms. Any pledge, reward, or purchase made through a third-party crowdfunding platform is subject to that platform's own terms of service, privacy policy, refund policy, and dispute-resolution processes, in addition to any specific campaign terms Radiant Botanics publishes. Rewards and estimated delivery dates presented in a crowdfunding campaign are aspirational, may change, and are not guarantees of delivery.
Any pricing, promotional offers, product configurations, or availability referenced on the Website are for informational purposes only, are subject to change without notice, and do not constitute an offer to sell. Errors, inaccuracies, or omissions may occur, and Radiant Botanics reserves the right to correct them at any time.

These Terms are governed by and construed in accordance with the laws of California, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Website will be brought exclusively in the state or federal courts located in Berkeley, California, and you consent to the personal jurisdiction of those courts.
We may update these Terms from time to time. When we make changes, we will update the "Effective date" at the top of this page. Material changes may also be communicated through the Website or by email. Your continued use of the Website after changes take effect constitutes your acceptance of the updated Terms.
Radiant Botanics may, in its sole discretion and without notice, suspend, restrict, or terminate your access to all or any portion of the Website at any time and for any reason, including for suspected violations of these Terms. All provisions of these Terms that by their nature should survive termination will survive.
